4.2 You are solely responsible for: (a) Maintaining the confidentiality of your account credentials; (b) All activities that occur under your account; (c) Immediately notifying us of any unauthorized use of your account or security breach.

4.3 We reserve the right to suspend or terminate accounts that contain false or misleading information or violate these Terms.

5. Subscription and Payment Terms

5.1 Service Plans and Pricing

The Service is offered through various subscription plans. Enterprise solutions are available based on specific client requirements and service availability. Detailed pricing and features for each plan are outlined on our website.

5.2 Payment Processing

(a) All payments are processed securely through Stripe, our third-party payment processor. (b) By providing payment information, you represent that you are authorized to use the payment method. (c) You agree to pay all charges at the prices in effect when incurred.

5.3 Subscription Terms

(a) Subscriptions are billed in advance on a recurring basis according to your chosen billing cycle. (b) Subscriptions automatically renew unless cancelled prior to the renewal date. (c) You may cancel your subscription at any time through your account settings or by contacting support.

5.4 Free Trial

(a) We may offer a free trial period for new users. (b) Trial periods automatically convert to paid subscriptions unless cancelled before the trial ends. (c) Users are limited to one trial period per organization.

6. Acceptable Use Policy

6.1 You agree not to: (a) Use the Service in any unlawful manner or for unlawful purposes (b) Attempt to gain unauthorized access to the Service or related systems (c) Interfere with or disrupt the integrity of the Service (d) Share or transfer your account access (e) Exceed usage limits applicable to your subscription plan

6.2 Data Usage (a) Automated access to the Service is prohibited without explicit written permission (b) Systematic downloading, scraping, or harvesting of data is prohibited (c) API usage must comply with documented rate limits

7. Intellectual Property Rights

7.1 Service Ownership

BrandBeacon.AI and its licensors own all rights, title, and interest in the Service, including all intellectual property rights.

7.2 User Content

(a) You retain ownership of any content you submit to the Service. (b) You grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content for the purpose of providing the Service.

9. Service Level Agreement

(a) Standard technical support is included in all paid subscriptions. (b) Support is provided via email at support@brandbeacon.ai. (c) Response times vary based on subscription tier and issue severity.

10. Term and Termination

10.1 These Terms remain in effect while you use the Service.

10.2 We may terminate or suspend your access to the Service: (a) For breach of these Terms (b) For non-payment of fees (c) If required by law (d) If we cease operating the Service

10.3 Upon termination: (a) All rights granted to you under these Terms will cease (b) You must stop using the Service (c) Your data will be retained for 12 months unless you request earlier deletion

11. Limitation of Liability

11.1 To the maximum extent permitted by law, BrandBeacon.AI shall not be liable for: (a) Indirect, incidental, special, consequential, or punitive damages (b) Loss of profits, revenue, data, or business opportunities (c) Any errors in AI platform analysis or reporting (d) Service interruptions or data loss

11.2 Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

12. Warranties and Disclaimers

12.1 The Service is provided "as is" and "as available" without any warranties of any kind, whether express or implied.

12.2 We do not warrant that: (a) The Service will be error-free or uninterrupted (b) Any results or analysis will be accurate or reliable (c) The Service will meet your specific requirements

13. Changes to Terms

13.1 We reserve the right to modify these Terms at any time.

13.2 We will notify you of material changes via email or through the Service.

13.3 Continued use of the Service after changes constitute acceptance of the modified Terms.

14. Indemnification and AI Disclaimers

14.1 Indemnification

You agree to indemnify, defend, and hold harmless BrandBeacon.AI, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from: (a) Your violation of these Terms (b) Your use of the Service (c) Any decisions or actions taken based on the Service's outputs or analysis

14.2 AI and Data Analysis Disclaimers

(a) Third-Party AI Platforms: The Service monitors and analyzes various third-party AI platforms. We have no control over these platforms and make no representations about their accuracy, reliability, or availability.

(b) Analysis Accuracy: While we strive for accuracy in our analysis and reporting:

  • We cannot guarantee the accuracy of AI-generated responses or content
  • Brand visibility metrics are approximations based on available data
  • Sentiment analysis and rankings are interpretative and may not reflect actual market perception
  • Historical data may be incomplete or inaccurate due to changes in third-party platforms

(c) Data Quality Disclaimers:

  • We do not verify the accuracy of third-party AI responses
  • Rankings and metrics may change without notice due to updates in AI platforms
  • Real-time data may be delayed or incomplete
  • Comparative analysis depends on available data points which may be limited

(d) Service Output Limitations:

  • Reports and analytics should not be the sole basis for business decisions
  • Users are solely responsible for verifying any information before acting upon it
  • We are not liable for any business decisions, actions, or strategies based on our analysis
  • Market positions and competitive analysis are subject to rapid changes

14.3 Release of Claims

By using the Service, you release BrandBeacon.AI from any claims, damages, or losses arising from: (a) Inaccurate or incomplete analysis (b) Changes in AI platform behaviors or responses (c) Business decisions made based on the Service's output (d) Lost opportunities or market positioning (e) Any indirect or consequential losses related to the Service's use

15. Governing Law and Jurisdiction

14.1 These Terms are governed by the laws of England and Wales.

14.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
